Huntersville Attorney for the Management of Medical Debt in Bankruptcy

If medical debt is the primary reason you are filing for bankruptcy, there is some good news. Bankruptcy courts divide all of your debt into two categories--secured and unsecured--with secured debts being the higher priority for repayment. Secured debt is backed by some type of collateral that can be foreclosed on or repossessed. Medical debt is unsecured and seen by the court as a low priority.

Your medical debt is very likely to be discharged or reduced during the bankruptcy process. Our attorneys will make reducing or eliminating your medical debt a high priority throughout your proceeding.

Legal Help Through Two Types of North Carolina Bankruptcy

You will typically have two choices when it comes to filing bankruptcy. Blossom Law PLLC will discuss both options or any alternative options with you to choose the one that makes the most sense for you. The two types of bankruptcy we usually use for individuals and families are Chapter 7 and Chapter 13. Our lawyers will guide your decision and discuss what your life after bankruptcy may look like with each type.

Chapter 7 completely eliminates your medical debt, credit card debt, and more. Most people walk away 100% debt-free. However, the downside is that some of your assets will need to be liquidated (sold off) so that the proceeds can be used to pay your creditors as much of what you owe as possible. This does not mean that you cannot keep anything - there are legal exemptions that protect things like your car and your home.

After a Chapter 13 bankruptcy, you will still have to pay back a portion of your medical and other debt - often only a comparatively small portion. During this type of bankruptcy proceeding, your debts will be reorganized so that you are only making one monthly payment for a predetermined amount of time - usually five years or less. The amount of this payment depends on your income, expenses, and the amount that you still owe, but it is designed to roughly equal your disposable income. After that time period passes, you walk away debt-free.
