Benefits of Chapter 7 Bankruptcy

If you are in debt, and creditors are contacting you to collect, if you file for any type of bankruptcy, it will trigger an automatic stay, which stops them from reaching out to you. If you are trying to decide if Chapter 13 or Chapter 7 is best for you, we highlight some of the benefits of Chapter 7 below.

Chapter 7 benefits:

  • Debt may be discharged, allowing you to achieve a fresh start. Note: certain types of debt may not be eligible for discharge.
  • Although Chapter 7 is considered a liquidation bankruptcy, not all assets or property will be sold. There are items that are exempt from liquidation.
  • There is no limit on how much debt you are trying to discharge.
  • There is no repayment plan.
  • Debt may be discharged in as little as 3 to 5 months.

What Debt Can Be Discharged?

Chapter 7 allows you to eliminate most credit card debt, medical bills, other consumer debt, and even small business debt if you meet certain qualifying criteria. The good news is that most people do qualify. You can even eliminate federal and state tax debt after certain conditions for repayment have been met. Most people are even able to keep their house and the family car if they agree to reaffirm the debt and continue to make timely payments.

How to Qualify for Chapter 7 Bankruptcy?

If you're wondering how you can qualify for Chapter 7 bankruptcy, the first step is to pass a bankruptcy means test. This process determines your eligibility by examining your monthly income against the state's median income for a family of your size. If your monthly income is greater than this median, you may not qualify for Chapter 7. In North Carolina, the annual income limit for filing Chapter 7 may be around $53,000, because that's approximately the value of the state's median income, although it can shift in either direction year-to-year.

The means test is required when more than half of the debt you owe is due to the purchase of consumer goods rather than outstanding debt for taxes, business, or tort debts.

Further qualifications include:

  • Filing taxes as an individual, married couple, or business owner
  • You haven't had a previous bankruptcy discharge within the past 8 years
  • You haven't had a bankruptcy dismissal within the past 180 days
  • You must complete a government-approved credit counseling program 180 days before bankruptcy discharge

What if You Do Not Qualify?

In order to qualify to eliminate your debt through Chapter 7, your debt-to-income ratio must meet certain criteria. If the calculation determines that you should be able to meet your debt obligations, you will qualify for Chapter 13 bankruptcy to restructure your debt.
